This privacy notice for Directorate of Agriculture, Government of Assam ("Company," "we," "us," or "our"), describes how and why we might collect, store, use, and/or share ("process") your personal data when you use our services ("Services") in the context of mobile application “Krishi Sarathi” (“App”). Your continued use of the App or provision of data or information thereafter will imply your unconditional acceptance to this Privacy Policy.
The “Information” (including data) provided by you to the “App” or collected from you may consist of “Personal Information” and “Non-Personal Information”. The term Personal Information shall include ‘sensitive personal information or data’ as may be provided under applicable law from time to time and as may be provided by you or collected by the “App” for the purposes as mentioned here in or as permitted under applicable laws.
PRIVACY STATEMENT
Your privacy is important to us. This privacy statement explains what personal data we collect from you and how we use it. We encourage you to read the summaries below. The Service-Specific Details below provide additional information relevant to particular the “App” (“Krishi Sarathi”).
PERSONAL DATA WE COLLECT
The “App” collects data to operate effectively and provide you the best experiences with our services. You provide some of this data directly, such as when you create an account. We get some of it by recording how you interact with our services by, for example, using technologies like cookies, and receiving error reports or usage data from software running on your device. We also obtain data from third parties (including other companies, weather.com for location specific weather data). We will not share your data with any third party or advertisers. We use de-identified data to provide relevant contextual information at different points in time. Personal Information is information collected that can be used to uniquely identify or contact you. Personal Information for the purposes of this Privacy Policy shall include, but not be limited to:
  • Your user name along with password
  • Your name
  • Your address
  • Your telephone number, e-mail address
  • Certain images/files that you choose to upload, we request your permission before uploading the same
 
APP DOWNLOAD
When downloading the App, the necessary information is transferred to the App store, in particular user name, e-mail address and customer ID of your account with the App store provider, time of download, and the individual device identification number.
This data processing happens in the context of your use of the App store and within the legal framework you have with your App store provider. We are not controlling this data processing and have no access to this data. However, we may receive anonymous aggregated statistical data from the App store providers based on this personal data.
APP USAGE
The core functionality of the App is to upload pictures of paddy that are affected by a disease or pest in order to receive an automated recommendation based on Package of Practice, Assam Agribusiness and Rural Transformation Project (APART) and Assam Agricultural University, Jorhat. The recommendation provided by the ‘App” is based on an algorithm using computer vision and machine learning. The correctness of recommendation cannot be attributed to any individual or organization. However, false positive and false negative cases should be brought to our notice by writing a mail to negpagri.assam@gmail.com. The “App” is also going to be used for collecting data:
  • Farmer – Expert connect through Q&A forum
  • Information dissipation on FAQ, Schemes etc
  • Weather Forecasting
  • Cultivation Pattern Analysis
  • Disease Occurrence Analysis for better assistances to the farmers
  • Location specific crop cultivated by the farmers (Crop land definition with geo fencing)
If you upload a picture of a plant, we collect in connection with such picture the following data:
  • User ID
  • Location (latitude, longitude, alteration, mobile network provider)
  • Timestamp
We allow the user to take photograph of infected plants even when there is no network connectivity with the mobile. In such scenario, we keep the photo in a temporary folder till the photo is pushed to the server and recommendation is provided to the farmer. While doing so, we access the file system of the mobile in the interest of ensuring support to the farmers to get the recommendation for the infected crop images, considering the fact that the crop field may not have smooth mobile network connectivity.
For the purpose of understanding the challenges faced by the farmers in their farms, we will store and process the data for the lifetime of the Services. However, in individual cases you may still be indirectly identifiable through the location data (in case the images taken are on your private property); we will not undertake any efforts to identify you by this data, and will not co-operate in doing so unless we are legally obliged and ordered to do so by a competent authority or court.
HOW TO ACCESS AND CONTROL YOUR PERSONAL DATA
You can view or edit your personal data online using the “App”. You can also make decide about collection and use of your data. How you can access or control your personal data will depend on which services you use.
NON – PERSONAL INFORMATION
The “App” may also collect information other than Personal Information from you. Such information may be stored in server logs. This Non-Personal Information would not assist us to identify you personally.
This Non-Personal Information may include:
  • Your geographic location
  • Details of your telecom service provider or internet service provider
  • The operating system of your system, device, your activities, access history
LINKS TO THIRD PARTY WEBSITE
Links to third-party advertisements, third-party websites or any third-party electronic communication service may be provided, which are operated by third parties and are not controlled by us, unless expressly specified. We are not responsible for any form of transmission, whatsoever, received by you from any third-party website. The information provided by you to such third-party websites shall be governed in accordance with the privacy policies of such third-party websites and it is recommended that you review the privacy policy of such third-party websites prior to using such websites.
REPRESENTATION
You hereby represent to Directorate of Agriculture, Government of Assam, that the information you provide to apps from time to time is and shall be authentic, correct, current and updated and you have all the rights, permissions and consents to provide such information or data to applications. Your providing of the information to the “App” shall be construed as your consent for consequent storage, collection, usage, transfer, access or processing of the same shall not be in violation of any third party agreement, laws, charter documents, judgments, orders and decrees. The officials of Directorate of Agriculture or Vidhi Analytica LLP or contracts or agents shall not be responsible for the authenticity of the information that you or any other user has provided. You shall indemnify and hold harmless Directorate of Agriculture or Vidhi Analytica LLP or contracts or agents any third party relying on the information provided by you in the event you are in breach of this and the paragraph above.
SECURITY
We are committed to protecting your personal data from loss, theft and misuse. We take all reasonable precautions to safeguard the confidentiality of your personal data, including through use of appropriate organizational and technical measures.
The security of your Personal Information is important to us. We strive to ensure the security of your Personal Information and to protect your Personal Information against unauthorized access or unauthorized alteration, disclosure or destruction. For this purpose, we adopt internal reviews of the data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to system that stores your Personal Information. We shall adopt reasonable security practices and procedures as mandated under applicable laws for the protection of your information. Provided that your right to claim damages shall be limited to the right to claim only statutory damages under Information Technology Act, 2000 and you hereby waive and release Directorate of Agriculture or Vidhi Analytica LLP from any claim of damages under contract or under tort. Directorate of Agriculture or Vidhi Analytica LLP is not liable for any loss or injury caused to you as a result of you providing your Personal Information to third party (including any third party websites, even if links to such third party websites are provided on the website). Notwithstanding anything contained in this Policy or elsewhere, Directorate of Agriculture or Vidhi Analytica LLP shall not be held responsible for any loss, damage or misuse of your Personal Information, if such loss, damage or misuse is attributable to a force majeure condition which is beyond the reasonable control of Directorate of Agriculture or Vidhi Analytica LLP. You agree that all Personal Information shall be retained till such time required for the purposes or required under applicable law, whichever is later. The Non-Personal Information will be retained indefinitely.
AREA OF OPERATION LEGAL JURISDICTION
The “App” shall provide services to the farmers residing within the geographical and administrative area of Assam, under Government of Assam (India) only. THE APPLICABLE LAWS AND REGULATIONS WILL BE IN ACCORANCE TO THE LEGAL PROVISION OF UNION OF INDIA AND LOCAL LAWS APPLICABLE FOR THE STATE OF ASSAM ONLY UNDER THE JURISTICTION OF GAUHATI HIGH COURT.
LANGUAGE PREFERENCE
The “App” provides the facility to opt for your language of preference, either “English” or “Assamese”. Keeping the most preferred language of Assam by the farmers community, the Assamese language is set as alternate language preference (English as default).
CONSENT
By accessing and/ or using the Services, you consent to the collection, use, storage, transfer and processing of your personal data in accordance with this policy. Please read this Privacy Policy carefully to understand how your personal data is handled and your rights in its regard. If you do not agree with any of the terms contained in this Privacy Policy, please do not use or access the Services.
PROCESSING OF PERSONAL DATA OF CHILDREN
You must be aged 18 years or over to avail of the Services offered by us. If you are aged below 18 years, please ensure your use of our Services is consented to by your parent or legal guardian.
DATA RETENTION
No data shall be deleted unless an explicit request for the same is received in the form an email to negpagri.assam@gmail.com. The data shall be removed within 48 hours from after receiving the email.
CHANGES TO PRIVACY POLICY
If we make any material changes to this Privacy Policy, we will notify you either through the email address you have provided us, or by placing a prominent notice on our Website, App and Community. Your continued use of the Service after we post any modifications to the Privacy Notice will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Notice.
